Overview

This presentation, presented by attorneys Lindsay Curcio and Stuart Reich, builds on the fundamentals of naturalization. The program examines several issues which may render an individual ineligible for naturalization. The presenters will discuss how to identify ineligibility issues as well as the analysis that must be made to determine whether a naturalization application can be submitted.

Applicants who did not file and/or pay taxes or who did not register for Selective Service if required, may raise issues of compliance as well as the good moral character requirement for naturalization. Individuals who made false claims of U.S. citizenship, whether knowingly or not, may find themselves not only ineligible for naturalization but also deportable.

Learning Objectives:

  1. Break down requirements and eligibility on who must file taxes and when you earn enough to file
  2. Identify documentation needed for naturalization application for eligibility
  3. Determine in what situations could false claim to US Citizenship arise, such as the I-9 process
  4. Counsel clients on considerations regarding maintaining a permanent resident status
