E-Discovery Fundamentals With Focus on ESI

Electronic information permeates every aspect of our lives. Inevitably, it will become a feature of, if not central to, claims and defenses in civil cases. This three-part series will begin with a consideration of the ethical duties of attorneys when dealing with electronic information and then will turn to ESI in civil cases, beginning with the duty to preserve before litigation and proceeding through discovery to use at trial. The series will also consider the latest developments, artificial intelligence, and, even more timely, “generative AI.”
