Biography

Erika M. Lopes-McLeman is a member of Dentons' Litigation and Dispute Resolution practice and the firm’s Insurance sector group. Erika is the Co-Chair of the Firm’s US Associates Committee and is the Associate Liaison to the Firm’s Diversity and Inclusion Committee.

Erika counsels and represents clients in an array of complex commercial disputes, including insurer-side coverage litigations and arbitrations. Erika’s insurance coverage practice includes representing insurers in matters including complex insurance coverage litigations, reinsurance arbitrations, and counseling insurers on complex claims. In the commercial litigation space, Erika has successfully represented clients as diverse as an international pharmaceutical company, a private equity firm, an IT company, and a national restaurant franchise, in an array of disputes.

Erika was born and raised in Mumbai, India and grew up traveling the world aboard merchant marine trade vessels. Erika remains an avid international traveler, and brings to every client relationship an innate ability to relate to people from diverse backgrounds. Erika is fluent in Hindi and has completed coursework in Marathi, Italian and Arabic.

Prior to beginning her career in private practice, Erika served as a law clerk to the Honorable Stuart J. Rabner, Chief Justice of the Supreme Court of New Jersey. Based in Dentons’ New Jersey office, Erika is a member in good standing of the bars of New Jersey and New York.


Experience


Insurance Experience

  • Successfully serving as lead defense counsel in New Jersey and New York for a major property insurer in connection with numerous property and flood insurance coverage lawsuits in both state and federal court. Successfully achieved dismissal of several actions through motion practice on various grounds.
  • Representing a national life insurer in litigation against insurance agents arising out of fraudulent life insurance applications.
  • Provided claims counseling and served as coverage counsel to a domestic life insurance company in matters arising out of the denial of claims for benefits, involving allegations of breach of contract, unfair claims practices, and insurance fraud.
  • Through aggressive motion practice at the outset of the case, succeeded in securing an order in federal court reducing multi-million dollar damages sought against property insurer in coverage action to a fraction of the original demand.
  • Served as insurer-appointed defense counsel to a stucco sub-contractor in connection with a complex construction defect claim brought by a homeowners’ association against a developer.
  • Served as subrogation counsel to a foreign insurer in a matter involving multi-property fire losses.
  • Represented a state liquidation bureau in an ongoing proceeding involving a large number of major policyholder claims.

Other Representative Litigation Experience

  • Achieved dismissal of complaint against an out-of-state private equity firm for lack of personal jurisdiction in a lawsuit that alleged millions in contractual damages stemming from the purchase of a tobacco escrow fund.
  • Secured dismissal of complaint brought by a franchisee against a national restaurant franchise in connection with a transfer of ownership.
  • Secured dismissal on summary judgment of all but one count in multi-million dollar undue influence trusts and estates litigation.
  • Representing a biotechnology company in a complex commercial litigation arising out of its efforts to raise financing prior to its initial public offering.
  • Representing an information technology firm in a federal court litigation arising out of the alleged improper software conversion of certain healthcare data.
  • Represented a manufacturer of pharmaceutical drugs in a complex commercial litigation arising out of an alleged breach of a supply agreement and alleged noncompliance with current good manufacturing practices.
  • Served as pro bono counsel to a local community theater in a lawsuit brought by a patron.
