Overview
The landlord-tenant relationship is a complex one that is often the subject of disputes and litigation. When such problems arise, it is important to not only understand the rights and obligations of the parties through consideration of the governing lease, applicable landlord-tenant statutes, and controlling case law, but to fully appreciate all options that may be available in ultimately developing going forward strategies and solutions to these problems. In recent years, this has been complicated by frequent legislative changes and local court practices developed to address COVID-related issues. While most COVID-specific measures have been rolled back, there are still constant changes in the law. Those working in this area must stay informed of these changes.
John Ivins and Alec Boyd, both with the law firm of Hirschler Fleischer, collectively have more than 30 years of experience practicing in this area. They will explore the complexities of handling these types of matters, addressing not only the general legal requirements and approaches for solving commercial and residential landlord-tenant disputes, but also addressing the implications of certain lease provisions in the commercial context and the various changes impacting the rights, duties, obligations, and remedies of the parties in the context of residential tenancies. They will also seek to address certain strategies and options for consideration in various circumstances encountered day-to-day in this area of the law.
Learning Objectives:
- Discuss the legal landscape that especially impacts residential tenancies
- Identify the landlord and tenant's rights, duties, and obligations established by the lease, applicable statutes, and controlling case law
- Develop an understanding of landlord-tenant litigation principles, including court requirements and possible defenses
- Explore the various litigation and non-litigation options and strategies that may be available for resolving landlord-tenant disputes
