While Independent Medical Examinations ("IMEs") may have previously been taken for granted as a matter of right for the defense, it has been a growing trend in personal injury litigation in Louisiana for plaintiffs to challenge the defense's request for an IME. Now referred to as Additional Medical Examinations ("AMEs"), as determined by the Law Institute and the Supreme Court due to concerns of unfair prejudice, this presentation by Christoper Billings, Partner at Breazeale, Sachse & Wilson, L.L.P., will explore the statutory authority behind AMEs along with the most recent and pertinent jurisprudence interpreting that authority.
