Overview
The Americans with Disabilities Act (ADA) is one of the most litigated US civil rights laws, with certain ADA claims topping the list of federal lawsuits alleging discrimination, including website accessibility, inaccessible physical facilities, failure to provide American Sign Language interpreters to deaf and hard of hearing people, service animals, and much more.
However, the ADA is still a law that is not fully understood by private businesses, state, and local governments, much to their liability peril. In our program, we will discuss recent ADA developments including court decisions, US DOJ enforcement and published guidance, and new lawsuits including a late 2022 case in Michigan alleging multiple disability discrimination claims about state and county buildings, including courthouses. In this course, presented by Bruce Adelson, we will discuss best practices and potential ADA trends to come.
Learning Objectives:
-
Discuss the most recent ADA developments
-
Identify key ADA terms that are very much center stage in today's ADA litigation environment and determine how best to manage situations involving website accessibility, certified ADA advocates, and comfort animals
-
Review best practices that can reduce the risk of ADA liability and unwelcome USDOJ attention
