Overview
This program is designed to provide an overview of the process used by nurses, life care planners, attorneys, and other experts in ensuring due diligence regarding future medical costs relative to expected Medicare payments to demonstrate a reasonable consideration of Medicare's interests in such future care. A basic understanding of the process aids attorneys and paralegals in evaluating the quality of reports provided and educates opposing parties on the rationale for the cost of future care demanded or offered.
These reports become important in beginning the process of compliance with the Medicare Secondary Payer Act and protecting Plaintiff's future related to Medicare as they have begun to decline payment for many services with the code "Liability MSA in place". Additionally, there is will be a review of the risk to Carriers in litigation where policy limits are not reached.
