Overview
This program will address advertising considerations in the fashion industry. Courts and the Federal Trade Commission have taken a broad view of what constitutes "advertising" to include any communications to the public to promote the advertiser's products or services, including product packaging, displays, social media statements, print and TV ads, etc. Failure to meet legal compliance can result in regulatory challenges by federal, state, and local authorities, or even lawsuits by consumers or competitors.
Learning Objectives:
- Identify and understand the essential elements of advertising claims
- Review and discuss red flags for claims that are potentially deceptive
- Discuss how to bring a claim for deceptive advertising, including proper choice of venue
- Analyze recent case law developments in these areas, as well as FTC actions, and discuss the potential impact on the fashion industry
