Overview

This program, presented by Scott E. Squillace, Esq., will discuss some of the unique aspects of estate planning that impact same-sex couples and non-traditional families. Following the first Trump administration, many same-sex couples face uncertainties regarding their rights and marriage options. Under President Biden, a shift back to Pro-LGBTQ+ policies happened, and a focus on equality returned to our highest office. However, in the wake of the recent national elections and as we prepare for a second Trump Presidency, there is increased fear and concern in the community about loss of rights, particularly through policy proposals outlined in Project 2025.

This program will focus on the history of LGBTQ rights, the development of case law, and its implications on the community. Attendees will learn about some of the pros and cons of marriage from a tax and estate perspective, and the unique planning options available to same-sex couples.  He will highlight the risks anticipated in the new Trump term and begin to discuss some defensive measures attorneys and their clients may consider.  Mr. Squillace is an attorney with over 37 years of experience and a dedication and focus on estate planning for the LGBTQ+ community. Through his experience, he will provide important information for same-sex couples contemplating marriage and estate planning.  He is the author of "Whether-to-Wed: A legal and tax guide for gay and lesbian couples" and has spoken nationally on this topic.

 Learning Objectives:

  1. Review the landscape of life and estate planning issues for those in the LGBTQ community
  2. Identify current trends about rights given change in Presidential administrations
  3. Advise clients and their advisors in this community on best practices for planning and protecting their loved ones and assets
