Overview
This program, presented by Anthony Bandiero of Blue to Gold Law Enforcement Training, will teach attendees about several emerging trends relating to search and seizure. These issues are eye-opening and fascinating, even for attorneys that don't practice criminal law. Emerging Trends is a two-part series. Part One focuses on issues relating to homes.
Part One will cover the following emerging trends:
When do police conduct a "search" while standing on curtilage?
A "knock and talk" is a common police investigative procedure. But when does this technique violate the Fourth Amendment?
Community caretaking versus emergency aid exception…when do they apply?
This program will benefit any attorney who deals with search or seizure issues. These topics are particularly relevant to prosecutors and defense attorneys.
Learning Objectives:
- Understand that homes and curtilage are two of the most protected areas under the Fourth Amendment
- Discuss socially acceptable practices that knock and talks must comply with
- Identify the difference between community caretaking and the emergency aid exception
