Overview

This program, presented by Deepika Ravi and Amy Richardson of Harris, Wiltshire & Grannis LLP, will explore the law governing attorney-client privilege, and trends in privilege decisions relating to in-house counsel roles. Ms. Ravi and Ms. Richardson will draw on court opinions as case studies to guide a discussion of the rules governing in-house privilege claims and trends in the treatment of the attorney-client privilege and work product doctrine. These case studies will include a discussion of privilege in the following contexts:

  • Lawyer as a Strategic Planner

  • Investigations for Non-Legal Purposes

  • Over-Sharing Information

  • Forwarded Nonlawyer Emails

  • Privilege Training for Employees 

The course will end with a discussion of the principles governing waiver, best practices, and practical tips to protect the attorney-client and work product privileges.
